ABOUT Attorney's FEES

  • The facts and seriousness or complexity of a criminal case will determine how much the attorney's fees will be. 

  • There is no charge for the initial consultation.

  • Talking with the client will help to understand the complexity of the case and to determine what the fee should be.

  • Depending upon the facts of each case, the fee might be charged at an hourly rate or as a flat fee.

  • The Arizona State Bar prohibits contingent fees in criminal cases (see ER 1.5(d)(2)).

  • The facts and seriousness or complexity of your case will determine how much the attorney's fees will be.
  • After talking with you in the initial consultation, at no charge, Mr. Ellinwood will be able to tell you what the fee would be.
  • Depending upon the type of case and the specific facts and complexity of your case, Mr. Ellinwood may work on a contingent fee basis, at an hourly rate, or for a flat fee.

  • A contingent fee is dependent upon whether you win or settle your case and the fee is a percentage of money you recovery.

  • If you do not recover a monetary award, there are no attorney's fees.

  • If your civil case results in a settlement of $100,000, for example, and the contingent fee is at the rate of 40%, the attorney's fee is equal to 40% of $100,000 or $40,000.
